§ 6-1. Prima facie evidence of violation.

  • (a)

    If any domestic animal shall be found in violation of the provisions of this chapter, proof of the violation and identity of the animal shall be prima facie evidence of the violation of this chapter by the person owning or having charge of or control of the domestic animal.

    (b)

    Any person found to be in violation of the provisions of this chapter shall not be subject to criminal penalties but shall be subject only to a civil infraction and the payment of a fine in the amount of $25.00 for each occurrence for which they are found to be in violation.

    (c)

    An infraction, for purposes of this section, is a noncriminal violation which is not punishable by incarceration and for which there is no right to a trial by jury or a right to court-appointed counsel.

    (d)

    Any person wishing to contest any fine imposed under the provisions of this chapter may do so by appearing in the county court.
