§ 42-93. Area with no existing drainage system.

In any area of the town where no approved positive drainage systems exists, the following shall be required:
(1)
Adjoining privately owned properties will not be adversely affected.
(2)
When swales within public rights-of-way are utilized for retention, the swale shall be of adequate capacity to retain the runoff from a one-inch rainfall and the equivalent of a 24-hour/three-year return storm event on the right-of-way and the adjacent and contiguous sites.
