§ 44-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Capital improvement shall mean physical assets constructed or purchased to provide, improve or replace a public and/or private facility to maintain or achieve an adopted level of service.

    Comprehensive plan shall mean a plan meeting the requirements of F.S. §§ 163.3177 and 163.3178 (Local Government Planning and Land Development Regulation Act).

    Concurrency shall mean the demonstration that specific public and/or private facilities and services are or will be available at the adopted level of service, as described in the town's comprehensive plan, concurrent with the impact of development.

    Deficiency shall mean the absence or degradation of public and/or private facilities or services below the level of service standard adopted within the comprehensive plan, including subsequent amendments.

    Development order shall mean any order by the town commission granting, denying or granting with conditions an application for a development permit pursuant to F.S. § 163.3164(5).

    Development permit shall mean any building permit, zoning permit, subdivision approval, rezoning, certification, special exception, variance, or any other official action by the town having the effect of permitting the development of land pursuant to F.S. § 163.3164(6).

    Level of service (LOS) shall mean an indication of the extent or degree of service provided by, or proposed to be provided by a facility based on and related to the operational characteristic of the facility. Level of service shall indicate the capacity per unit of demand of each facility.

    Phasing shall mean an incremental staging of development which is to occur within a specified period of time and may require individual or separate certificates of occupancy for individual structures.
