§ 58-76. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Critical habitat shall mean the place or type of site where a species naturally or normally nests, feeds, resides or migrates, including characteristic topography, soils and vegetative cover.

    Developer shall have the meaning as defined in F.S. § 163.3164(4).

    Development shall have the meaning as defined in section 66-1.

    Final development order shall mean any order granting, denying or granting with conditions an application for a development permit as defined in F.S. § 163.3164(7).

    Habitat preservation plan shall mean a series of land management techniques applied to maintain the viability of species in a specific location. These techniques include, but are not limited to, controlled development, limiting access, planting, preserving or removal of vegetation, exotic species control, maintaining hydraulic regimes and monitoring.

    Native plant communities shall mean vegetative areas which contain plants indigenous to south Florida, as identified in Native Trees and Plants for Florida Landscaping Bulletin, Florida Department of Agriculture. A native plant community may consist of a landscaped area or an area kept in its natural state. The purpose of a native plant community is to establish and/or create areas which provide visual and noise buffers, conserve water use, are aesthetically pleasing and provide habitat for flora and fauna.

    Open space shall mean that area of a development not containing buildings or improvements such as driveways or swimming pools. Open space shall consist primarily of vegetated areas such as lawns, landscaped areas, or preservation areas.

    Rare, endangered and threatened species and species of special concern shall mean those species listed as rare, endangered or threatened species or species of special concern by one or more of the following agencies:

    (1)

    U.S. Fish and Wildlife Service.

    (2)

    Florida Game and Fresh Water Fish Commission.

    (3)

    Florida Committee on Rare and Endangered Plants and Animals.

    (4)

    Florida Department of Agriculture.

    (5)

    Treasure Coast Regional Planning Council.

    Redevelopment shall mean any alteration of an existing structure or property which increases the appraised value by 50 percent or more of value.

    Wetlands shall mean those areas characterized as wetlands pursuant to F.S. §§ 403.91—403.929.
