§ 58-77. Intent and purpose.

  • (a)

    This article is intended to implement and be consistent with the town comprehensive plan, F.S. § 163.3161, and Rules 9J-5 and 9J-24, F. A. C., by ensuring that all development within the town avoids or minimizes damage to native plant communities, wetlands and/or critical habitat for rare, endangered or threatened species or species of special concern, whenever prudent or feasible.

    (b)

    All development within the town shall blend into the natural setting of the landscape for the enhancement of sound, orderly economic growth and development, and for the protection and preservation of property values, native plant communities and critical habitat for rare, endangered or threatened species or species of special concern.

    (c)

    The intent of this article is to be consistent with all federal and state regulations pertaining to rare, endangered or threatened species or species of special concern. In cases where inconsistencies may exist between this article and other applicable federal or state regulations, the more stringent of the regulations shall apply.
