§ 58-79. Enforcement and penalties.

  • (a)

    Any person, as defined in F.S. ch. 373 or 403, or anyone acting on behalf thereof, who shall violate or fail to comply with any provisions of this article shall be guilty of a misdemeanor punishable according to law. However, in addition to or in lieu of any criminal prosecution, the town shall have the power to sue in civil court to enforce the provisions of this article.

    (b)

    Violations of the provisions of this article, upon conviction, may be punished by a fine not to exceed $500.00 per violation per day, or by imprisonment in the county jail not to exceed 60 days, or by both fine and imprisonment pursuant to the provisions of F.S. § 125.69.

    (c)

    Damage to the native plant communities may result in an order to restore to preexisting site conditions.

    (d)

    In addition to the sanctions contained in this section, the town may take any other appropriate legal action, including, but not limited to, administrative action and requests for temporary and permanent injunctions to enforce the provisions of this article. It is the purpose of this article to provide additional cumulative remedies.

    (e)

    Each day that a violation of this article is continued or permitted to exist without compliance shall constitute a separate offense punishable upon conviction in a manner prescribed in this section.

    (f)

    The provisions of this article shall be enforceable by the town commission.
