§ 58-85. Post development activities.

  • (a)

    All land required to be preserved for native plant communities or for critical habitat must be maintained in accordance with the habitat preservation plan.

    (b)

    To verify adherence to the habitat preservation plan, the town's planning and building administrator shall make periodic inspections of the preserved areas.

    (c)

    All areas that are preserved as native plant communities shall be cleared of vegetation, trash or other debris in accordance with the habitat preservation plan.

    (d)

    There shall be no use of mechanical equipment in accomplishing the maintenance of preserved native plant communities or critical habitat unless specifically authorized in writing by the town commission and incorporated as part of the habitat preservation plan.

    (e)

    There shall be no use of fertilizers, herbicides or pesticides in the native plant communities or critical habitat, except for projects conducted under the authority of F.S. §§ 373.451— 373.459, the Surface Water Improvement and Management Act, or governmentally authorized mosquito and fruitfly control programs.
