§ 30-4. Penalties for violation.

(a)

It shall be unlawful for any person to violate any of the parking regulations of the town and a fine of $25.00 shall be assessed for the following:

(1)

Overtime parking.

(2)

Parking on wrong side of street.

(3)

Parking at yellow curb.

(4)

Blocking driveway.

(5)

Parking on sidewalk.

(6)

Trespassing by vehicle.

(7)

No parking (designated hours).

(8)

Parking too close to fire hydrant.

(9)

No parking anytime.

(10)

Double parking.

(11)

Obstructing traffic.

(12)

Parking in loading zone.

(13)

Vehicle parked across lines designated parking space.

(14)

Vehicle parked in wrong direction on one way street.

(b)

All other parking violations shall be as prescribed by appropriate state statute or other ordinance relating thereto, and the fine for same shall be $25.00 unless otherwise specified therein.

(c)

Penalty for violating handicapped parking restrictions. It is unlawful for any person to stop, stand or park a vehicle within a parking space marked "Parking by Disabled Permit Only," unless such vehicle displays a parking permit issued pursuant to F.S. § 320.0848 and such vehicle is transporting a person eligible for the parking permit. The civil penalty for a violation of this section, which would also be a violation of F.S. §§ 316.1955 and 316.1956, shall be $150.00.

(d)

Delinquency payment for nonpayment of parking violation penalties. Failure to pay penalties for violations of this section within 72 hours from the time of issuance of the violation shall result in an additional delinquency penalty to the violator in the amount of $10.00. Failure to pay the full penalty within five days of notice of such obligation may result in a summons being issued ordering and directing the violator to appear in county court, or civil proceedings may be commenced to effectuate collection. The violator shall be responsible for all costs incurred by the town to enforce the provisions of this section.

(e)

Service charge for nonpayment of parking violation penalties. Failure to pay penalties and delinquency assessments for violations of this section within 60 days of the issuance of the parking violation shall result in a service charge to the violator in the amount of $20.00 per citation in addition to the cost of the violation and delinquent penalty. Failure to pay penalties and delinquency assessments for violations of this section within 90 days of the issuance of the parking violation shall result in an additional service charge to the violator in the amount of $25.00 per citation in addition to the cost of the violation, the original delinquent penalty and service charge.
